Terms and Conditions of Sale
- Where the caravan/motorhome and goods (herein collectively referred to as “the goods”) to be supplied are to be ordered from the Manufacturer Newport Caravans Limited (herein collectively referred to as “Newport Caravans”) undertakes to assist the Purchaser in obtaining the benefit of any warranty or guarantee given by the Manufacturer in respect of the goods
- Newport Caravans is a company registered in England and Wales, company registration number 6651531 and their registered office is at 4 Kings Square, Bridgwater, Somerset, TA6 3YF. Our trading premises are at Kings Parade, Off Frederick Street, Newport, NP20 2DU, we also trade at The Caravan Camping and Motorhome Show which takes place in February and The Motorhome and Caravan Show which takes place in October at the Birmingham NEC, B40 1NT, either on the Manufactures stand or our usual stand. - When the Purchaser places an order for a caravan or motorhome a deposit is paid, in the case of a caravan the deposit required is £500 and in the case of a motorhome the deposit requied is £1000 to Newport Caravans, a part exchange caravan or motorhome may also be taken as a deposit. This will result in the removal of the caravan or motorhome from sale or in the case of a new caravan or motorhome, an order will be placed with the manufacturer.
- All monetory deposits are non-refundable. However, in the event of the Purchaser being unable to obtain a finance agreement or, if, when Newport Caravans carrys out a full inspection in the part exchange caravan or motorhome and the part exchange does not meet the original description and Newport Caravans and the Purchaser cannot agree on a suitable value for the part exchange a full refund of the deposit will be made. In the event of the Purchaser cancelling the order, the deposit will not be refunded, it will however, be held for up to 12 months to use against the purchase of other goods.
- Where the agreement is for the purchase of goods to be ordered from any Manufacturer, Newport Caravans will use their best endeavours to deliver by such date as may be desired by the Purchaser, but they do not guarantee time of delivery, and Newport Caravans shall not be liable for any loss or damage suffered by the Purchaser through any reasonable or unavoidable delay in delivery howsoever caused.
- In the event of the Manufacturer ceasing to make a caravan/motorhome of the type (specific make, model) ordered by the Purchaser, Newport Caravans Limited shall return the deposit in full to the Purchaser and cancel this agreement without further liability on his part.
- Where Newport Caravans agrees to allow part of the purchase price to be satisfied by the Purchaser delivering a used caravan in part exchange, the used caravan/motorhome shall be delivered to and accepted by Newport Caravans subject to the following conditions: a) that the used caravan shall be delivered to Newport Caravans in the same condition as described by the Purchaser at the time of the order including any items required to be present with any part-exchange; and b) that any quoted or estimated part exchange value for the used caravan will only be confirmed upon physical inspection by Newport Caravans; and c) that either (i) the used caravan is the absolute property of the Purchaser and free from any Hire Purchase Agreement or other legal encumbrance whatsoever, or (ii) the used caravan/motorhome is the subject of a Hire Purchase or Credit Sale agreement capable of assignment by the Purchaser and of cash settlement by Newport Caravans, and in such a case the amount of the purchase price allowed by Newport Caravans in respect thereof shall be reduced by the amount paid in settlement by Newport Caravans.
- In the event of a used caravan/motorhome being taken in part exchange for the goods Newport Caravans may forthwith proceed to dispose of such used caravan/motorhome taken in part exchange. The agreed allowance in respect of such used caravan/motorhome taken in part exchange shall not necessarily be the cash price that the Newport Caravans may achieve in a subsequent sale and in the event of the used caravan/motorhome being sold prior to the delivery date of the goods and in the event either that the goods are not delivered or for some reason as stated in this contract the order is cancelled the sum to be paid by Newport Caravans to the Purchaser in respect of the used caravan/motorhome taken in part exchange and so sold as aforesaid shall not be more than the price at which the used caravan was sold.
- The Purchaser shall pay Newport Caravans the balance of the purchase price of the goods before delivery, in the case of a bank transfer, this is to be at least 24 hours prior to delivery of the caravan/motorhome. In the case of cash it will be to the maximum of £5,000. Delivery will not take place before the date indicated on the order form unless an earlier delivery date is agreed.
- If the Purchaser shall fail to take delivery of the goods or to perform any essential obligations under this agreement, Newport Caravans shall be at liberty to treat the agreement as repudiated and thereupon: a) The deposit shall be forfeited. Unless specifically detailed in writing on the order, the Purchaser’s liability will not exceed the full value of the deposit. b) Newport Caravans shall be entitled to dispose of the goods as he may think fit and shall not be under any liability to account to the Purchaser for the price received thereto.
- Any notice to be given under this agreement shall be deemed to have been duly served if sent by Recorded Delivery to the Purchaser’s last known address in the Seller’s possession and subsequently recorded as having been delivered.
- 'First Time Buyer' refers to a customer who does not have a caravan or motorhome to part exchange with a new purchase.
- The terms of this agreement do not affect and cannot exclude any of the Purchaser’s statutory rights as a consumer. For more information on these statutory rights contact a local authority Trading Standards Department or Citizens Advice Bureau.
